Han Kun’s data practice is fed by the wider firm’s experience in the TMT sector. More than 20 practitioners are part of the growing data team, which provides advice to domestic and international clients alike. Aside from mainstream data privacy and cybersecurity matters, the firm has rich experience in advising multinational clients on data localisation issues, having spent years advising on the country’s restrictions on international transfers.

Regular clients include social media giants Tencent and Baidu, as well as international cloud leader Amazon Web Services. Leading hotel Marriott is also on the books, as are Mercedes-Benz and Geely Auto.

Team

Kevin Duan in Beijing and David Tang and Min Zhu in Shanghai lead the practice, joined by three further Beijing and Shanghai partners and a dozen associates. Kemeng Cai was promoted to the partnership in early 2022.

Work highlights

Marriott has tapped Han Kun for advice on issues as diverse as international transfers, cybersecurity compliance, data compliance gap analysis and innovative data use on projects that have spanned not only China but the EU, Hong Kong, Singapore and Taiwan. Major Chinese biotech company and covid vaccine manufacturer Sinovac has also received advice. Duan is the company’s lead counsel for a global data compliance project as it expands its market and manufacturing capabilities around the world; he has also provided advice on PIPL, data localisation and cybersecurity compliance. There is some solid confidential investigations work, but Han Kun’s practice is heavily slanted towards non-contentious matters.
